These General Terms and Conditions (“Terms”) apply to all orders placed via the online shop operated under the PINaPIN brand.

1. Scope

These Terms apply to all orders placed via our online shop. They apply to consumers and businesses. In the case of businesses, these Terms also apply to future transactions without the need for explicit reference.

Any conflicting or supplementary terms used by the customer shall not apply unless expressly agreed by us in writing.

2. Contractual partner and formation of contract

The contract is concluded with FLOW ECOMMERCE MICHAŁOWSKI I WSPÓLNICY SPÓŁKA JAWNA.

By placing products in the online shop, we make a binding offer to conclude a purchase contract. The contract is formed when you submit an order by clicking the order button and we confirm acceptance of the order.

We reserve the right to accept or reject orders at our discretion. Payment must be received and processed before an order is accepted.

3. Contract language and storage

The contract may be concluded in the following languages: English, German, French, Dutch, Spanish, Italian and Polish.

We store the contract text and provide order data to the customer after the order is placed.

4. Delivery conditions

Delivery costs may apply and are indicated during the ordering process.

Goods are shipped only; personal collection is not available. Delivery times are estimates and not guaranteed.

Once the goods are handed over to the carrier, the risk of accidental loss or damage passes to the customer.

5. Payment

Available payment methods include advance payment, credit card, PayPal, Google Pay and Apple Pay.

The customer warrants that the provided payment details are accurate and that they are authorised to use the selected payment method.

6. Statutory right of withdrawal

Consumers are entitled to the statutory right of withdrawal in accordance with applicable law.

Details regarding exclusions, time limits and effects of withdrawal follow mandatory legal regulations.

7. Damage during delivery

If goods are delivered with visible transport damage, consumers should report such damage to the carrier immediately and inform us without delay.

Failure to do so does not affect statutory rights, but helps us assert claims against the carrier.

8. Warranty and guarantees

Statutory warranty rights apply to consumers.

For businesses, warranty liability for defects is excluded to the extent permitted by law, except in cases of fraudulent concealment or mandatory statutory liability.

Any additional guarantees are indicated separately with the relevant product.

9. Liability and limitation of liability

We are liable without limitation for damages resulting from intent, gross negligence, injury to life, body or health, or mandatory statutory liability.

In all other cases, liability is limited to foreseeable and typical damages at the time of contract conclusion.

The services and products are provided “as is” and “as available” to the fullest extent permitted by law.

10. Platform, intellectual property and prohibited use

The online shop is operated using the Shopify platform. All purchase contracts are concluded exclusively between the customer and PINaPIN. Shopify is not responsible for any aspect of the sales relationship.

All content, trademarks, texts, images and designs are the intellectual property of PINaPIN or its licensors and may not be used without prior written consent.

Customers may not misuse the shop, including by unlawful access, data scraping, interference with security mechanisms or infringement of third-party rights.

11. Final provisions

Polish law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

For business customers, the place of jurisdiction is our registered office.

If any provision of these Terms is held invalid, the remaining provisions remain unaffected.
